§ 34-4. Failure to return books or material.

  • (a)

    It shall be unlawful for any person, who has borrowed, withdrawn or otherwise checked out any book or other material from the city public library, or any branch or bookmobile thereof, to fail to return said book or other material and pay all charges in connection therewith within 21 days after receipt of written notice from said city public library, that said book or material is overdue. Said notice shall be by certified mail, return-receipt requested, with the return card showing the receipt or refusal by the addressee.

    (b)

    It shall be unlawful for anyone who agrees in writing to be responsible for the care and proper return of any book or other material loaned by the city public library, or any branch or bookmobile thereof, and who fails to return or cause to be returned said book or other material and pay all charges in connection therewith within 21 days after receipt of written notice form said city public library that said book or other material is overdue. Said notice shall be by certified mail, return-receipt requested with the return card showing the receipt or refusal by the addressee.

    (c)

    This section shall be posted in a prominent place in the city public library and called to the attention of anyone who borrows, withdraws or otherwise checks out any book or other material or who agrees in writing to be responsible for the care and return of same.

    (d)

    In any prosecution for any violation of this section, any membership application card or other writing on file with the city public library shall be prima facie evidence of the genuineness of any signature appearing thereon.

    (e)

    Any person violating any provision of this section shall, upon conviction, be fined an amount not to exceed $50.00.
