§ 9.00. Limitations on Rezoning Requests.

  • The City Council's rejection of a rezoning request establishes that the property owner shall not submit the same request to the Planning Commission within the next twelve (12) months from the date of the rejection. A withdrawal of the application for rezoning, after the Planning Commission public hearing, but before the City Council public hearing shall also require a twelve (12) month time period before another application may be submitted. The Planning Commission may adjust this time period if an unusual situation or circumstance warrants another hearing. Each time the rezoning amendment application is filed, the non-refundable administrative/application fee must be paid. Under no condition shall the fee be refunded for the failure of such proposal to be enacted into law.
